People aren’t the only ones who live in slavery. Five killer whales have been named as plaintiffs in a lawsuit filed by PETA (People for the Ethical Treatment of Animals) against Sea World, which says they deserve the same constitutional protection from slavery as humans.

Sea World’s lawyers say that the ruling could effect not just how other marine parks or zoos operate, but even on the use of sniffer dogs to detect bombs and drugs. BBC News quotes Theodore Shaw, SeaWorld’s lawyer, as saying, "Neither orcas nor any other animal were included in the ‘We the people’ when the Constitution was adopted."

BBC quotes Jeffrey Kerr, the lawyer representing the whales, as saying, "By any definition these orcas have been enslaved here" (NOTE: Subscribers can still listen to this show).

But one of the orcas–named Tilikum–isn’t waiting for the judge’s ruling. He drowned his trainer before horrified spectators two years ago, which led to a ban on Florida Sea World employees going into the water to perform tricks with the orcas, and he has also been linked to two other human deaths.
